AUCTION TERMS & CONDITIONS Warranty : All information contained herein is true and correct to the best of our knowledge, but is in no way guaranteed as to the accuracy of description made, year model, mileage, etc. Everything is sold AS IS - WHERE IS without warranty as to usefulness or merchantability. Although every item listed is presently committed to this sale, we do not assume responsibility for any items that may be withdrawn due to circumstances beyond our control. This catalog is furnished as a guide only. Some equipment may require modifications to meet export and/or safety regulations. For information on your custom obligations, please contact your customs broker. ALL ANNOUNCEMENTS MADE ON DAY OF SALE SUPERSEDE ANY PRINTED MATERIAL. Sales Taxes : All sales of non-titled vehicles are subject to sales tax unless you have proper re-sale exemption. Purchases by Dealer for Re-sale: It will be necessary sale day to execute a Certificate of Resale for all purchases. This Certificate must bear your Sales Tax Exemption Number. Failure to furnish this information will require payment of sales tax on all purchases. Tax Exempt Buyers must also present their state’s sales tax exemption certificate. Registration Notice : Anyone wishing to bid on items in the auction must register and obtain a bidder card. Anyone bidding for an account other than their own must register as such. Auctioneer reserves the right to reject the bid of anyone who is not a registered bidder. Terms & Payment Procedures : Full Settlement Is Due on the Day of the Sale. All checks must be made payable to Henderson Auctions. Cash, cashier’s check, or wire transfers will be accepted. Personal or company checks must be accompanied by a bank letter of credit guaranteeing payment. We also accept all major credit cards. There is a 4% Convenience Fee when payment is made when paying via credit card. Bank drafts are not accepted. Notice to Foreign Buyers: Purchasers without United States bank accounts are required to pay in US funds by wire transfer. International credit cards are not accepted. 1. Payment not made per terms and conditions of auction will be subject to late fees, penalties and interest plus expenses related to collection cost. Any balance due the day after the final removal date noted on the invoice will be due by purchaser at a rate of 18% per annum. The fee will begin from date of auction. NO EXCEPTIONS 2. All items must be removed by the date stated on your invoice. Items left after this date will be subject to storage fees of up to $100 per item per day. Items that are moved to storage site will be subject to moving charges at our discretion. Items will be sold for storage cost at next auction if fees not paid and items removed. NO EXCEPTIONS Loading Times: See the front of the buyer guide Please Note: It is important that the trucking company has knowledge of the lots that they will be hauling. It is the buyers/haulers responsibility to ensure that all items are picked up, including buckets, forks, or any additional pieces that are not physically attached to the machine.
