AUCTION TERMS & CONDITIONS Warranty: All information contained herein is true and correct to the best of our knowledge but is in no way guaranteed as to the accuracy of description, including but not limited to year model, mileage, condition, etc. Every item is sold "AS IS - WHERE IS" without warranty expressed or implied as to usefulness, merchantability, or fitness in any manner whatsoever. Purchaser is hereby advised that no guarantee is made of any kind as to whether or not equipment or items meet requirements of federal, state or local laws. Although every item listed is presently committed to this sale, we do not assume responsibility for any items that may be withdrawn due to circumstances beyond our control. Some equipment may require modifications to meet export and/or safety regulations. For information on your customs obligations, please contact your customs broker. This catalog is furnished as a guide only. All items are sold on an "AS-IS, WHERE IS" BASIS AND WITH ALL FAULTS. Sales Taxes: All sales of non-titled vehicles are subject to sales tax unless you have proper re- sale exemption. Purchases by Dealer for Re-sale: It will be necessary on auction day to execute a Certificate of Resale for all purchases. This Certificate must bear your Sales Tax Exemption Number. Failure to furnish this information will require payment of sales tax on all purchases. Louisiana residents must present their LDR issued sales tax exemption certificate. Mississippi residents must present their Mississippi issued sales tax certificate. Registration Notice: Anyone wishing to bid on items in the auction must register and obtain a bidder card. Anyone bidding for an account other than their own must register as such. Auctioneer reserves the right to reject the bid of anyone who is not a registered bidder. Terms & Payment Procedures: Full Settlement Is Due on the Day of the Auction. Payment for purchases made by internet bidding is due no later than 3 business days following the final auction day. Cash, Cashier's Check, or Wire Transfers will be accepted as form of payment. All checks shall be made payable to Henderson Auctions. Personal or Company checks must be accompanied by a bank letter of guarantee. Major credit cards are accepted, however, there is an added 4% convenience fee. Bank drafts are not accepted. Notice to Non US Buyers : Purchasers without United States bank accounts are required to pay in US funds by wire transfer. Payment not made per terms and conditions of auction will be subject to late fees, penalties and maximum lawful interest plus expenses related to collection costs. Interest, penalties, and late fees will begin from due date of invoice. NO EXCEPTIONS! All items must be removed by March 2, 2022. Items remaining after this date will be considered abandoned and may become property of the auction firm. Items that are moved to storage site will be subject to moving and storage fees. NO EXCEPTIONS! Please Note: If you (Buyer) are having your items shipped via a transportation carrier, you MUST submit the bill of lading to our office BEFORE the trucker arrives to pick up your item. You can email it to auctionoffice@hendersonauctions.com . It is important that the trucking company has knowledge of the lots that they will be hauling. It is the buyers/haulers responsibility to ensure that all items are picked up, including buckets, forks, or any additional pieces that are not physically attached to the machine. Henderson Auctions is not responsible for any item left off the truck.
